• Creciendo Services: when this policy mentions “Creciendo Services,” it refers to the website available at https://www.creciendo.com.ph, and products and services Creciendo provides that are accessible over the internet. 
• Country: Where Creciendo is based, which is The Philippines.
• Merchant: Creciendo itself and/or establishments authorized by Creciendo to sell through their Service.
• Third-party service:  refers to APIs, external  service providers, such as cloud services, payment gateways. To understand why we use third party services, you may visit our privacy policy.
• You: a person or entity that is registered with Creciendo to use the Services.

By using Creciendo Services, registering an account, or making a transaction, you hereby consent to our Terms and Conditions.

1. Use of Personal Data. You provide us (and third-party services we use) your consent to collect, store, and use information, including but not limited to, personal data (as defined in Data Privacy Laws and our Privacy Policy). The purpose of which is to provide Creciendo services—which may include but are not limited to—accessing our products; user management; customer experience management; service improvement; statistical, analytic, and research purposes; and customer communications. 
2. Data Sharing. You provide Creciendo your consent in the processing of your data and information for the following purposes: accessing our products; user management; customer experience management; service improvement; statistical, analytic, and research purposes; and customer communications. 

   Creciendo guarantees that it is in full compliance with the requirements under applicable laws, rules and regulations with respect to data security, and data protection. Furthermore, Creciendo warrants that it has the necessary infrastructure, procedures, rules, and regulations in place to protect the integrity, accuracy, security, and confidentiality of your data while it's being collected, used, stored, and moved around.

3. Your Responsibility. As we ensure that your information is secure, you are also responsible for maintaining the security of your account by not sharing any of your sensitive information and creating a strong password. You are responsible for any activity in your account, whether or not you authorized the same. Thus, you must notify Creciendo of any known or suspected unauthorized use of your information.
4. Location Information. Creciendo values your privacy and ensures that the collection of your location is only to effectively use some of our product features and help us provide better user experience.

Creciendo uses "Cookies" to remember which parts of our website and products you've visited. A Cookie is a small piece of information stored on your computer or mobile device by your web browser.  We use Cookies to enhance the performance and functionality of Creciendo services but are non-essential to their use. Without Cookies, features like videos may not work, and you might need to log in each time you visit our services because we wouldn't remember you had logged in previously. Most web browsers can be set to turn off Cookies, but doing so might mean you can't use some parts of our services properly or at all. We never put Personally Identifiable Information in Cookies.

Subject to the terms and conditions set forth in these Terms of Use, Creciendo grants you a revocable, non-transferable, limited license to access Creciendo Services and the materials thereon provided you comply with this Terms of Use, and all copyright, trademark, and other proprietary notices remain intact. 
• Creciendo website is intended solely for informational use, and our products should be utilized according to the contract terms. If you do not agree to these terms of use, Creciendo requests that you refrain from using Creciendo Services. All materials on Creciendo Services (excluding any third-party materials), are the property of Creciendo and are protected by intellectual property laws. Creciendo retains all rights, titles, and interests in these materials.
• You agree not to interfere with or try to disrupt the operation of Creciendo Services in any way. You must not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from Creciendo Services.
• Aside from the limited permission granted in the previous paragraph, Creciendo does not provide you with any explicit or implied rights or licenses under any patents, trademarks, copyrights, or other proprietary or intellectual property rights.
• You are also not permitted to replicate any content from Creciendo Services on other websites or media unless agreed upon in contracts. Any software or materials available for download or use from Creciendo Services will be governed by their respective license terms, conditions, and notices. 

This Agreement shall remain in effect until terminated by you or Creciendo. Failure to adhere to this terms of use will result in the immediate termination of any granted rights, without prior notice, and you must immediately cease using Creciendo Services and delete all copies of the downloaded materials in your possession or control. 

If you decide to terminate using Creciendo Services, we will keep your personal data secure for at least five (5) years. Following the Data Privacy Act of 2012, we will ensure that your personal information is safely disposed of to prevent any further use, unauthorized access, or disclosure to other parties.

• All content on Creciendo Services, including, but not limited to the text, logos, button icons, images, videos, audio clips, digital downloads, data compilations, and software, are the property of Creciendo, except when explicitly stated otherwise in the contract or agreement. When it is clearly specified in the contract that another party owns specific content or intellectual property, those ownership rights are honored accordingly.
• If you are a copyright owner or are representing the owner, and believe that any content on Creciendo Services violates your copyright, please contact us with the following details: (a) a signature (either physical or electronic) of the copyright owner or an authorized representative; (b) identification of the specific material claimed to be infringing; (c) your contact information, including address, phone number, and email; (d) a statement from you indicating your belief, in good faith, that the material is being used without authorization from the copyright owner; and (e) a statement that the information provided is accurate and that you are authorized, under penalty of perjury, to act on behalf of the copyright owner.

• Creciendo Services provide you with access to a variety of resources. Such resources, including any updates, enhancements, and new features are subject to these Terms of Use.
• Creciendo may also provide links and pointers to Internet sites maintained by third-parties. Creciendo does not operate or control in any respect any information, products or services on these third-party sites. We are not responsible for examining or evaluating, and we do not warrant the offerings of any of these businesses or individuals or the content of their websites. Creciendo does not assume any responsibility or liability for the actions, product, and content of all these and any other third parties. You should carefully review their privacy statements and other conditions of use.
• You agree to indemnify and not hold responsible Creciendo and any of its affiliates, officers, directors, agents, and employees from any claims or demands, including reasonable attorney fees, made by any third party due to your breaking this Terms and Conditions, any related terms, or your violation of any law or the rights of another person.

• Creciendo's liability is governed strictly by the terms agreed upon in our contracts with clients. We are responsible for our products and services within the scope of these agreements. Any direct, indirect, incidental, special, exemplary, or consequential damages arising from the use of Creciendo Services, or from accessing linked sites or resources over the internet are subject to the terms mutually agreed upon between both parties.

• This agreement shall be governed by applicable laws of the Republic of the Philippines. Any disagreements about these Terms and Conditions should first try to be  settled amicably. Should the parties not come to an amicable settlement or dispute arises in connection with this Terms of Use, including any questions regarding its existence, validity or termination shall be referred to and solved by arbitration following the right rules.

• You understand that breaking the Terms of Use could cause serious problems that monetary damages may be difficult to ascertain or an inadequate remedy. That's why you agree that besides other rights, Creciendo can seek and obtain injunctive relief to make someone follow these rules if they're broken, without needing any bond or surety.
• In the event of a lawsuit or action by any parties under these Terms and Conditions to enforce any of its terms, you agree that if Creciendo is deemed to be the prevailing party as determined by final judgment, not subject to appeal, of a court of competent jurisdiction, Creciendo can ask for the money spent on lawyers, experts, and court costs, along with any other help the court decides to give.

• Creciendo Services may contain inaccuracies, typographical errors, and clerical errors. Creciendo disclaims any obligation(s) to update our website and products unless agreed upon in our client contracts.
• We don't guarantee that the materials, advice, statements on our website, and products are accurate, enough, or complete or that any other information you see is reliable. You acknowledge that any reliance on such statements or information shall be at your sole risk. Creciendo reserves the right, in its sole discretion, to correct any errors or omissions in any portion of our website and products at any time without notice. 
• The website is for informational purposes only and should not be used as technical advice in any manner. Suppose the court decides that any part of these Terms of Use cannot be enforced, the rest of the Terms of Use will still apply, as long as the unenforceable part doesn't change what each person can do under these Terms of Use.

• Creciendo reserves the right, at its sole discretion, to change, modify, add, or remove any portion of these Terms of Use in whole or in part at any time. Changes in these Terms of Use will be effective immediately when notice of such change is posted. 
• Your continued use of Creciendo Services after any changes to these Terms of Use are posted will be considered acceptance of those changes. Creciendo may terminate, change, suspend, or discontinue any aspect of Creciendo Services, including the availability of any feature(s) at any time. Creciendo may also limit certain features and services or restrict your access to certain sections or all of Creciendo Services without notice or liability. 
• You hereby acknowledge and agree that Creciendo may terminate the authorization, rights, and license given above at any time at its own sole discretion. Upon such termination, you shall immediately destroy all materials.
